Presidential decree which is a rule of law issued by a head of state (such as the president of a republic), according to certain procedures (usually established in a constitution). To develop the capacity of ministries and other governmental agencies and to improve the participation of professional and experienced Afghans in reconstruction of the country, following is approved:

Article 1: The recruitment of expert/ professional Afghans for ministries and governmental agencies, irrespective of ethnicity, language and religion factors, will be based on merit.

Article 2: Ministries and governmental agencies may propose in Tashkeel (structure) positions inline with the program procedure, based on their needs, to Directorate of Capacity Development – IARCSC.

Article 3: Political positions in ministries and governmental agencies’ Tashkeel can not be covered under this program. 

Article 4: The salaries and benefits of the Afghan experts will be paid according to the program norms from the trust fund set up for this purpose.

Article 5: The IARCSC is assigned to develop a procedure for effective use of the trust fund and implementation of this program.

Article 6: Amendments to procedure mentioned in the article 5 may be made, as required, by the chairman of IARCSC in consultation with leadership committee.

Article 7: This decree comes into force on the day it is signed; this decree should be published in the Official Gazette.

Presidential Decree Islamic Republic of Afghanistan 

Recruitment of Afghan Experts through Lateral Entry Program (LEP) To build and develop the capacity of Ministries and other Government Agencies and to enable the participation of Afghan experts the following is approved:

Article 1: The recruitment of Afghan experts for Ministries and Government Agencies will be based on merit.

Article 2: Ministries and Government Agencies, based on their needs, may request the Independent Administrative Reform and Civil Service Commission (IARCSC) to recruit Afghan experts.

Article 3: The salaries and benefits of Afghan experts will be paid from Afghanistan Reconstruction Trust Fund (ARTF) set up for this purpose. Article 

Article 4: The IARCSC is assigned to develop a procedure for effective use of Lateral Entry Program and the implementation of this decree.

Article 5: This decree comes into force on the day it is signed. This decree should be published in the Official Gazette.

To build and develop the capacity of ministries and other Governmental agencies and to enable the participation of professional expatriate Afghans the following is approved:

Article 1: The recruitment of expatriate Afghans for Ministries and Governmental Agencies will be based on merit.
Article 2: Ministries and governmental agencies, based on their needs, may request IARCSC to recruit Expatriate Afghans.
Article 3: The recruitment and final selection of Expatriate Afghans will be made by Ministerial Advisory Committee for Administrative reform, which is established under section 2 of article 30 in Administrative reform and civil services commission (IARCSC) regulations.
Article 4: The salaries and benefits of expatriate Afghans will be paid from ARTF Expatriate component (ARTF EX.C) set up for this purpose.
Article 5: The IARCSC is assigned to develop a procedure for effective use of (ARTF-EX.C) and the implementation of this decree.
Article 6: Amendments to procedure mentioned in the article 5 may be made, as required, by the chairman of IARCSC in consultation with MAC.
Article 7: This decree comes into force on the day it is signed; this decree should be published in the Official Gazette.
